End User Licence Agreement

This End-User License Agreement (EULA) is a legal agreement between you (either an individual or a single entity) and the Provider (Epilepsy Ireland) of this Software for the software product [Epilepsy Ireland App], which includes computer software and may include associated media, printed materials, and "online" or electronic documentation ("software product").
By installing the software product, you agree to be bounded by the terms of this EULA.
If you do not agree to the terms of this EULA, do not install or use the software product.
Purpose of the software product
The purpose of the software product is to assist you in managing and taking control of your epilepsy. The seizure diary is a tool to help you record relevant information on your seizures and the reminder service assists you in taking your medications on time and keeping & preparing for medical appointments. This is not a substitute for professional medical advice. You should consult your doctor, or other health professional, before making any decisions that could affect your health or the health of others.
Functionality
While every effort is made in ensuring that the software product fulfils its purpose in assisting you manage your epilepsy, Epilepsy Ireland does not warrant that: (i) the service will meet your own personal requirements, (ii) the service will be uninterrupted or error-free, (iii) the results that may be obtained will be accurate or reliable, (iv) any errors in the software product will be corrected.
To the extent permitted by law, in no event shall Epilepsy Ireland be liable for any direct or indirect or consequential/special loss or damage resulting from the use or the inability to use or any other matter relating to the functionality of the software product. Your use of the software product is at your own risk.
Changes to the software product
Epilepsy Ireland reserves the right at any time, with or without notice, to update, modify or discontinue, temporarily or permanently, the software product or any part thereof. Epilepsy Ireland shall not be liable for any loss or damage arising from modifications, suspensions or discontinuance.
While we will attempt to notify users of upcoming updates and modifications via our website www.epilepsy.ie, such updates or modifications may at our discretion, be pushed out to app users automatically with little or no notice.
Should it be discontinued, it will continue to work on your device until software updates render it obsolete. The app may cease to function for a variety of other reasons, including, but not limited to damage to your phone. In order to maintain uninterrupted service in the case of your phone being damaged, lost or stolen, it is your responsibility to ensure that your data is backed up regularly using an appropriate, secure method.
Data Security
All the information you record using the software product will be held and stored on your own personal phone and at your own risk. Epilepsy Ireland takes no responsibility for the security of data stored on your phone. We recommend that you take all possible steps to keep your personal information secure.
Use of Information
Epilepsy Ireland processes data in accordance with our Privacy Policy. Please note that regarding the software product, Epilepsy Ireland does not maintain or have access to any information about users of the product or to any of the personal information or data you store on your phone including your login details or answers to your security questions. This information is stored on your handset. Should you forget your login details, you can retrieve your information by correctly answering the security questions you completed when setting up your profile.
Data Ownership
All the information you record using the software product will be held and stored on your own personal phone. Your profile and the data you upload belong to you. Epilepsy Ireland claims no intellectual property rights over the data you store or transmit.
Data Responsibility
The software product permits you to create and store information on your own phone and to transmit this information by email. The safety, security and privacy of your phone and the information that you store on it or transmit from it are your responsibility and not the responsibility of Epilepsy Ireland. The use is therefore at your own risk. Epilepsy Ireland assumes no responsibility or liability for the delay, failure, interruption, or corruption of any data stored on or transmitted to or from.
You are responsible for maintaining the security of your username and password. Epilepsy Ireland shall not be liable for any loss or damage arising from your failure to comply with this security obligation. Please note that Epilepsy Ireland can not provide a password retrieval service.
Copyright
The copyright for the software product and all the images and content contained belongs to Epilepsy Ireland or third parties and cannot be reproduced, duplicated, or sold by any other person or organisation without the express consent of Epilepsy Ireland or such third parties.
Changes to Terms and Conditions
Epilepsy Ireland may update these Terms and Conditions in conjunction with the release of new versions of the software product or at any time at our discretion and without notice. Revisions to these Terms and Conditions will be posted on our website www.epilepsy.ie. Any new features added from time to time, including the release of new tools and resources, are subject to these Terms and Condition. Continued use of the software product after any such changes shall constitute your consent to such changes.
Breach of Terms and Conditions
If Epilepsy Ireland determines that a user has breached these Terms and Conditions, we may at our discretion, discontinue the use of the service.
Acceptance of Terms and Conditions
By activating the software product, you agree to the Terms & Conditions stated herein. You acknowledge that you are responsible for all use using your account, and that these Terms and Conditions apply to all usage of your account.
The software product is intended for use by adults over the age of 18 years. Users who are minors are required to obtain the consent of their parents or guardians before consenting to these Terms and Conditions.
Governing law
This agreement will be governed by and construed in accordance with the laws of Ireland and any dispute between us will be resolved exclusively in the courts of Ireland.
